North Carolina catering permit requirements

The threshold question in North Carolina is not which permit a caterer needs but whether food service is permitted at all — and the answer is yes, at the level of the statute, for anyone charging for food. The state does not treat catering as an informal activity; it treats it as a food establishment that happens to move.

The authority is G.S. 130A-248 — the statute under which the state adopts rules for the sanitation of food establishments, naming food stands, meat markets and temporary food establishments among its subjects. Under it, serving food to the public for pay is a permitted activity with inspection attached, whether it happens in a dining room or at a folding table on the beach. A caterer is not a restaurant with a delivery van; it is an establishment type the law already anticipated.

The rulebook that authority adopts is specific: 15A NCAC 18A .2650 — 2009 Food Code adopted — the state's rules at 15A NCAC 18A Section .2600 incorporate by reference the 2009 FDA Food Code as the base sanitation code statewide. North Carolina even keeps a path for the unusual case: under FDA Food Code 2017, the Department may grant a variance from its own rules in accordance with the 2017 Food Code if the variance will not result in a health hazard or nuisance condition. The code is the floor, and the variance is the signed exception to the floor — never a private workaround.

For events, the vehicle is the temporary food establishment permit: Temporary food establishment permit required — the regulatory authority issues a permit to each temporary food establishment complying with Rules .2665 through .2669, no food preparation may occur before the permit is issued, and TFEs are not eligible for transitional permits. The fee is fixed at Temporary food establishment permit $75.00 per permit issued. That is the whole event-side apparatus: one permit, one fee, a fifteen-day application clock, and a rulebook for what may be cooked where.

Two personnel requirements ride on top. The operation must have a certified food protection manager — Certified Food Protection Manager required, someone with supervisory authority over preparation and service who has passed a test that is part of an accredited program, with 210 days to comply from permit issuance for a new establishment to comply. And in Dare County the local layer is concrete: Environmental Health Specialists review an application and plan before any food-handling permit issues, through a Food and Lodging Institutions program administering eighteen state-regulated programs.

For a customer, the structure reduces to a single check: a lawful caterer can name their permit — establishment or temporary — and the county that issued it, and can point at a certified manager. For an operator, it reduces to a calendar: plan review, then application, then permit, then the first prep. The statute has ordered the steps for everyone; the only question is whether the vendor you are talking to has walked them.
